You can get a replacement battery from any of the sponsors(top right corner of site has the links). I have dealt with a battery so low the board wouldn't register that it turned on, and refuse to go into charge mode. Also brought mine back to life when it wouldn't hold a charge for more than 24 hours. I basically kept charging it over and over again. If you marker is weird about going into charge mode after you turn the switch on, or the battery refuses to hold a charge, you most likely do need to replace it.

Okay - I just bought a dark iR3 from eBay and was having similar problems (except the thing with the vibrating grip)... It was not charging and there were some exposed wires near the connection between the grip and the charger.
I unscrewed the connection cover (it's a twist off black plastic piece). This revealed a red and blue wire that were soldered to an aluminum nipple-esque connection. The red wire was touching the blue wire, which was causing a short, thus the charger could not properly do its job.
Solder the blue wire back into place (somewhere near the top - or nipple connection) and the red wire needs to be soldered after it is threaded through a small hole near the bottom of the aluminum block area. I would show you my connection, but to idiot proof the whole operation I hot glued everything for added protection. Maybe someone without a problem can open his up and show you how the proper connection should look. Either way, I would still suggest hot gluing...
